1. Acceptance of Terms

By accessing or using this website (“Site”), requesting a quote, or engaging Orbital Agency (“we,” “us,” or “our”) for digital marketing services, you agree to these Terms of Service (“Terms”).

2. Services Provided

Orbital Agency provides digital marketing and creative services including but not limited to:

Website and landing page design

Search engine optimization (SEO) and blogging

Video and advertising production

Social media management

Email and review marketing

Branding, design, and marketing consultation

Specific deliverables, pricing, and timelines are defined in written project proposals, quotes, or agreements issued to the client.

3. Payments and Billing

All services are billed according to the package or custom plan selected.

Monthly services are due in advance at the start of each billing cycle unless otherwise stated.

Ad spend budgets (Google, Meta, TV, etc.) are paid directly by the client to the respective platforms.

Late payments may result in suspension or delay of ongoing services.

Deposits or retainers for project-based work are non-refundable once production begins.

4. Term, Renewal, and Cancellation

Standard marketing plans renew month-to-month.

Either party may cancel with 30 days’ written notice before the next billing period.

If the client cancels early during a prepaid period, no partial refunds are issued unless otherwise agreed in writing.

Orbital Agency reserves the right to terminate services immediately if a client engages in abusive conduct, illegal activity, or persistent non-payment.

5. Client Responsibilities

Clients agree to:

Provide accurate business information, access credentials, and creative materials needed to complete work.

Review and approve deliverables in a timely manner.

Comply with all advertising and content laws, including copyright and truth-in-advertising standards.

Orbital Agency is not responsible for delays caused by missing client materials, approvals, or third-party platform changes.

6. Creative Rights and Ownership

Full ownership of final, paid deliverables transfers to the client upon final payment.

Orbital Agency retains the right to display non-confidential work in our portfolio and marketing materials.

Any stock images, licensed fonts, or third-party assets used remain the property of their respective owners.

7. Results and Guarantees

Orbital Agency’s strategies are designed to generate leads and growth, but results can vary based on market conditions, competition, and client participation.

We proudly offer a 6-Month Lead Guarantee:

If you don’t generate enough leads to cover your monthly cost within six months, you’ll only pay for your ad spend until you do.

This guarantee applies only to clients maintaining consistent campaigns, ad budgets, and communication throughout the guarantee period.

8. Limitation of Liability

To the fullest extent permitted by law:

Orbital Agency is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our Site or services.

Our total liability shall not exceed the amount paid by the client for services in the previous 60 days.

We do not warrant uninterrupted website operation or third-party platform performance (Google, Meta, etc.).

9. Confidentiality

Both parties agree to keep confidential information private, including pricing, strategies, and client data, except where disclosure is required by law.

10. Intellectual Property

All text, design, code, images, and materials on this Site are the property of Orbital Agency unless otherwise noted.
You may not reproduce, modify, or distribute any content without written permission.

11. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Florida, particularly Charlotte County, without regard to conflict of law principles.
Any disputes shall be resolved in the courts of Charlotte County, FL.

12. Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with a new effective date.
Continued use of our Site or services after changes means you accept the updated Terms.
